Common Trademark Terminology

Fanciful (Coined): Imagine you create a brand-new word that has no meaning in any language. It's like inventing a unique name for your special toy that nobody has heard before. Since it's one-of-a-kind, it's the easiest to protect because it only belongs to your toy.

Arbitrary: This is when you use regular words, but they have nothing to do with what you're selling. It's like calling your coffee shop "Banana" even though you only sell coffee. The name doesn't relate to your product, which can be good for trademarking.

Suggestive: Suggestive trademarks hint at what your product is about without directly saying it. It's like naming a soft drink "BreezeFizz." It doesn't spell out "soda," but it suggests something refreshing and fizzy.

Descriptive: These trademarks describe exactly what your product does or is. Imagine you name your bakery "Delicious Pastries." It's clear what you sell, but it's hard to protect because others may need to use those words to describe their baked goods.

Generic: Generic marks use everyday words that everyone uses for that product or service. Imagine you want to trademark the word "Computer" for computers you sell. That's like trying to trademark the word "Chair" for selling chairs – it's too common and can't be protected as a brand. If everyone calls chairs "chairs," it's generic.
